Mears Drivers Allege They Are Employees, Not Independent Contractors

 

A number of chauffeurs for Mears Transportation have filed a class action lawsuit alleging wage violations. According to the lawsuit, the company wrongly classifies the chauffeurs as independent contractors when they should be employees. The lawsuit states that the drivers are given Mears business cards and uniforms and drive fully insured and fueled company cars. “There is no credible basis for classifying the luxury chauffeurs as independent contractors, given the amount of control exerted over them on a daily basis,” state the plaintiffs’ attorney. The lawsuit requests that drivers be classified as employees, which should bring them higher pay.
